Red Bull Pays $13 Million In Class Action Lawsuit For Not Actually “Giving You Wings”

I want to meet the guy who guzzled a Red Bull, checked his watch after a few minutes and was like “Where the hell are my wings? This company is bullshit. I’m suing!”
For over 20 years, Red Bull has been lying to consumers by using the slogan “Red Bull gives you wings,” and now they’re paying $13 million dollars for not ACTUALLY giving you wings. Lucky for you, if you’ve bought a Red Bull even once in the last 12 years, you’re eligible for a $10 cash settlement, or (surprise, surprise) $15 worth of free Red Bull.
It all started when the Plaintiff, Benjamin Careathers claimed he had been drinking Red bull since 2002, but felt mislead by the brand’s slogan, which insinuates increased performance, concentration and reaction speed. The claim stated, “Such deceptive conduct and practices mean that (Red Bull’s) advertising and marketing is not just ‘puffery,’ but is instead deceptive and fraudulent and is therefore actionable.” News flash, dude: sugar will make you hyper, but you won’t turn into Superman. You won’t fly. In reality, you’ll probably get a sugar high and crash in a couple of hours.
In defense of their product and marketing tactics, Red Bull issued the following statement:
“Red Bull settled the lawsuit to avoid the cost and distraction of litigation. However, Red Bull maintains that its marketing and labeling have always been truthful and accurate, and denies any and all wrongdoing or liability.”
Would you claim your money if you drank Red Bull? (100 words)

89 comentarios:

  1. I have never drunk Red Bull but if I had drunk it,I would not claim the money.
I think it is not necessary to drink a red bull if you want to be active and with more concentration . on the contrary I will drink a coffee.I think it is healthier and it can give you the same things.
I will not claim the money because it is so obvious that this drink is not going to give you wings. However, I think that people that have drunk red bull have the right to claim it.

  2. Red Bull is a stimulating drink, which make you feel more nervous, dynamic and energetic, because it contains different substances that change the normal functions in our body.

This brand has an especial slogan which says “Red Bull gives you wings”. Some people have claimed about it because they think the brand is lying. It is motivating because the consumers say that they have been drinking this drink for a long time and they don’t have observed any different situation in their physical conditions.
The brand has replayed that it is obvious that if you drink Red Bull, you won’t have wings, but you will feel more energetic because the drink has a lot of sugar and some stimulates. For this reason they declare theirselves innocent and free of any responsibilities.

In my opinion, drinks like Red Bull or Monster, are not healthy for ourselves, because it produces an alteration and a change in our body. Besides it tastes horrible too, so people mustn’t drink this type of stimulating. But if I had drunk Red Bull, like this person, I wouldn’t have claimed them, because I think it is obvious that you are never going to have wings. Consequently, if you try to claim the firm, you won’t get anything because this trade mark is very famous and it would be very difficult to win them

I do not see correct that him proclaims itself anything for which the intention of these company is not that the red bull you of wings but you are mas active. On the other hand he would buy myself one it to drink and to claim that it does not give me wings couple that these ten dollars were giving to me and with this money to be able to buy me a couple of them mas. I hope that this response is for what you ask and I lack dream nothing of content not pabalabras, me to proved a very interesting text.

  4. No, because I know the advertisement is false, I don´t drink red bull because I don´t like energetic drinks like that, I prefer coca-cola, but the advertisements of coca-cola are false too, advertisements are only for caught your attention and to the people know the product, but you shouldn´t believe in all that television said, because if all was true this world would be crazy, people can fly and run very fast, cars can fly, you earn a lot of money very fast, but this is the real life and I think in the real life you only can work a lot or study, meet friends, hang out with your friends and relax if you have some free time, or do sport, but in the real life you can´t fly only drinking red bull.

  5. No, I think that I should not claim my money for this reason. I know that I can hope drinking a Red Bull. I think people should not claim money for this reason because it is clear that the sentence “Red Bull gives you wings” should not be interpreted literally. Normal people should know that they could not fly if they drink Red Bull and also if they do not drink Red Bull. They should also know that humans cannot have wings and cannot fly. Some people try to earn easy money from industries looking for any reason although they are not right.

  6. In fact, I saw this advertisement at first time three years ago. It is not an ad like the others. It is true that many advertisements give you and information and promise you things that are not true. In my case, I will not claim the money because you must be so silly to believe a drink could give you wings. I think the message that it wants to transmit is “If you drink redbull you will feel excited, like flying”. People who think you will get wings if you drink this drink will probably be people who do not think too much. There are many energetic drinks such as Monster or Burn which probably have the same contents but Rebdull had known the way to be known around the world.

  7. No advertising Red Bull is not real.
It is subjective because it really does not give you wings.
It is foolish to ask for money because they can not see well what the bull brand advertising network offers .
You can make easy money because the ad is cool and attracts young and drink .
You can not ask for money red bull for being stupid and believing that makes you run faster etc
But if 10 million to give me if I want to buy a lot of clothes and shoes.
    I wish it were true

  8. I´m a frequent drinker of Red Bull but I am not going to claim the money I have spent in the company because I don’t think the brand make any lie to the people because you have to be crazy to aim that a drink could turn you into a superhero. The effect that Red Bull causes in the people depend on the type of person, characteristics or weight of each one. But it´s true that these drinks cause a change in the body of the person because it has different ingredients like Taurine or Cafeine which causes a strange sensation of powerful, hyperactive and energize. So each one could buy whatever he want but not pretending that the marketing is exactly what the product make.

  9. I will not claim my money because I understand that the slogan "Red Bull gives you wings" is just for get money and draw the attention of the customers. I think that this slogan have just only one sense: you will get the power or the energy because Red Bull is an energetic drink and obviously you will not get wings to fly because only the animals and insects have wings.
If someone is claiming for their money, i just have to say that they are losing their time because that is just publicity and actually, i think it is a good slogan for an energetic drink.

  10. Nowdays the class action lawsuit are fashionable and by individuals activities that nobody forces you, an example is smoke and lung cancer, claims that often arise are abusive.
When we are misleaded or damaged in some sense we can claim, that is not bad, but in the case that presents the news nobody forces you to drink a Red Bull, and we must understand that the slogan "Red Bull gives you wings", is a commercial fhrase not to be taken literally, but there are people who believe that by taking a can of Red Bull is going to get higher level of mental focus, increased learning capacity, reaction, etc., that is to be felt like flying, physically and mentally
We can ask to what extent this belief arises because we believe?, innocently or because advertising is so strong, insistent that ends forcing us to believe the unbelievable as this one.
I think we should be responsible for our acts and not hide behind that false advertising us, because we are adults to have criteria and differentiate what is a technique to sell what is absolute truth. If no malicious intent in company Red Bull advertising can be misleading worse is the person requesting money after drink a Red Bull and complain if you do not expect miracles. In this case I would not claim anything and of course the first I don’t drink Red Bull.

But I am sure if it lies for example in something paintful like “Redbull does not have cholesterol”and it has it, and them a person with problems of cholesterol buy it and drink it thinking that redbull is not going to make them ill and it does it. With something like the example of a person who claim his money because redbull did not give him wings I think that it is ridiculous and it is not a motive for claim nothing or discuss about it because logically a drink is not going to make you fly or give you wings.
In conclusion I would only claim if it is something harder.

I don't drink Red Bull because I don't like it and also because it is a drink very perjudicial for your health . It can provoke heart attack and it can be very addictive too .
However , if I drank Red Bull, I would ask money in case it leaves me sequels or health problems, but I would not claim money because Red Bull doesn't give me wings . In my opinion , the man is crazy or high on drugs .
For all these reasons, I would never buy Red Bull

  14. I think it is ridiculous to claim money for the drink just because its supposed effects don’t be successful because people should drink it simply because you like the taste but it is true that perhaps the information and advertising that we heard be something exaggerated
I believe Red Bull does contain some sort of unknown addictive substance of some type because it does nothing for me energy-wise, yet I find myself really craving one from time to time. It is also insanely expensive. I know they can charge it because people pay for it, which brings me back to the 'addiction' element.

I wouldn`t claim my money or sue any Company. I understand that many times adverts include catch-phrases to persuade people to buy things. These phrases are not necessarily true.
Personally, I don’t like drinking Red Bull because it makes people feel nervous. I prefer other kind of drinks, for example soft-drinks without caffeine, juices and something like that.
I’m against of energy drinks, I think that they are unhelpful to study, although I know that many people use them to keep awake all night. I think that young people should be in favour of healthier foods and drinks.

But to me it seems very funny campaign ads and Red Bull is very good. They just want to sell and we get a good product.

Red Bull Pays $13 Million In Class Action Lawsuit For Not Actually “Giving You Wings”

On the one hand, I am agree with the text, I defend their ideas. Red Bull began with an advertisement that would seem true, but gradually we realize that's a lie. It is normal that consumers are angry and want their money, I would be like, but I have not been a regular consumer of this product.
I've drunk only twice. It has never given me power or superiority, in my opinion it is a normal soft drink. It is clearly advertised in order to sell the product with false claims.
On the other hand, I do not know if Red Bull has to return money to consumers disappointed, but in my opinion they should, because they sold a different product to that claim, and have misled consumers.
There will be people who still believe this, but in general we know is totally false, and Red Bull has to stop with this, and if required by law, to Demosthenes the rights of consumers.
Finally, I think the solution would be to return the money to consumers, it would make campaigns or social movements (lawsuits, complaints ...) to end this false and that others do not fall as we have fallen.

  31. No way! That is pointless. This kind of news make me think how silly can be a person. Firstly, i think it is not necessary clarify in this example of ad that the company has used the comparation between the wings with the sensation you feel after drink Red Bull, like hyperactive for a few hours.
But this example can make me think in what level companies lies us ¿should we do something respect? This is more visible such us “lotion creams wich eliminate every aging signs”. There is no lotion wich eliminate but people still buying it; and what is worse: companies still afirm false products.
To sum up, it is important to have stricting controls that do not allow companies offer a product wich no keep the expectatives for was created for

I think that it is only marketing, and it not have to be realted with the reality. If someone are going to claim the money is so opportunist or is excesive silly because he believed that this drink would give him wings really.
Anyway, I think that the advertisings have to reflect the real product, but inside of of certain limits

  33. Clearly no money would ask if I drink a Red Bull. obviously I will not have wings to take an energy drink that is marketing and not have to be very smart to realize. If you were asking for money, we would have to denounce also very many other brands like Coke saying uncovers happiness, open a bottle of coke I'm not happy or think it is ever. These people who claim to brands for false advertising to call it somehow seem boring without these ads serious tele aburridisima with how well are those ads even though you know it's a lie I love the imagination that can reach have.

  34. I would not claim money for several reasons: first because is that the phrase "red bull gives you wings" is an advertising resource that what you mean is that you'll be more awake to that drink you with more energy, secondly because a person has sufficient capacity know for taking a drink will not you out wings then is clear that is an advertising resource for attention, and if you want to take it or not. What happens is that there are people who want to get money from all sides, then they call for things that don't make sense because if someone saw the ad and really believed that it would give him wings a drink go two things or not this very well that person or does not have sufficient maturity to believe that.

I dont think that Red Bull is biable to give you energy and vitality. Personally I prefer to drink some coffee or another energy beverage because they are more healthy and more natural.

  37. Would you claim your money if you drank Red Bull? (100 words)
Publicity has an amazing power all over the world and can make people change their points of views and thinking. Because of that is really important not doing false advertising.
"Giving you wings", I would have never thought that Red bull’s company tried to device anyone with this slogan because is obviously false, it’s something not literal. I would have never realized it could be a false advertisement, so I wouldn’t claim any money.
I have always interpreted Red bull’s slogan as if it wants to inform you that the drink has caffeine and it will probably makes you feel more active, but, of course, you will never get flying because of having it.
However I could understand that is not the most suitable advertisement if we want to avoid false advertising, so I wouldn´t disagree if it would have been removed before, but I don’t see a reason enough to denounce the company, unless I could make sure I will earn a lot of money as Benjamin Careathers did, in that case I would claim my money.
To conclude, I will have never had that idea for something so simple, but next time I consume any kind of product, I will check if their advertisement is correct or it tells something that actually does not happen.

Redbull like Monster, Burn, etc is rubbish. All these drinks are bad for our bodies, natural laws have provided a body assimilates natural things. Not even regular soda are good, we only offer that we should drink water, tea, milk, and natural fluids. I do not drink soda, I do not recommend it.
These drinks are very dangerous for athletes, that accelerates the heart more than normal and can cause heart attacks. Deaths like this are becoming more frequent.

Advertising of different brands try to alert the customer in any way so they make irreal sentences. It is obviously that you won't go to fly if you drink Red Bull, so I think that there isn't any problem.

  47. En mi opinión veo una tontería que una persona se crea un lema como el de Red Bull. Ninguna bebida energética te va a ``dar alas´´.

  48. Never claim something as it is assumed that it is an advertisement and that has nothing real.
I think red bull has some component that makes you more active but it is obvious that gives you wings is just something to draw attention of the consumer.
I think also that you should not drink this drink frequently because to have that effect must be made with a mixture of substances that are not good for the body. I also do not need to drink red bull to be more active or to have more performance as there are healthier ways to not be tired.
Almost all energetic bebids have some addictive or harmful and we must take these drinks only on special occasions.

In conclusion, never would ask why not reclaim money

On the other hand, I wouldn´t ask for money because I buy Red Bull because I like it, not because of wings. What is more, there ir no need to take things literally, it is only a slogan.
Personally I wouldn´t ask for money.

If you consume it, you should be aware about it. The sportive person must´t drink it because it is ilegal and you would be acused for doping. In my opinión, it will be resported because it could make a sick society and unhappier, so we must to solve it right moment.

  51. No, I would never claim the money for drinking Red Bull, i have actually drunk so much red bull and many other brands that are similar to red bull. Before i bought it for the first time, i obviously knew Red Bull wasnt going to give me wings though, and those ads telling us that type of "bullshit" was just marketing. Its true that it keeps you awake and active because of whats Red Bull compound of, but I would be lying if I said that when u bought it and drink it I thought it would give me wings. I understand that there are people who thiought that drinking Red Bull was going to give them wings, even though i find it really weird. Certainly there are other products way healthier than Red Bull to stay awake like coffee, but its also true that each person is free to choose the product they want go drink and buy, like i respect those who want to claim theor money for all the red bulls they have drunk.

  53. Really I would no claim. I think that if you have nothing to do and you have money enough to claim you can do it to try to finish with all those marketing strategies that can damage someone. For example, for children, this kind of advertising can be dangerous, because they believe thing word by word. And you can remember that boy that died when he tried to fly with the superman custom. And on the other hand to claim is not free, if you want to arrive anywhere you need a lawyer to represent you, and sometimes, lawyers are more expensive than the money they are going to pay you.

I think that it is a drink that make you more active and alert but not to fly.(like it said in the TV ad)
It must be banmed this type of ad because it can be very dangerous for many people like childrens who can believe it.

It is a brand of energy drinks has given much money to his inventor because it allowed you to sponsor football teams, formula 1, motocross and extreme sports. The slogan of this brand is the reason why the complainant has complained to brand the product does not improve performance or concentration of personas. I think they should warn is the danger of mixing the drink with any alcoholic beverage because their reaction is not good for the human body. I would not report this brand because all advertising is misleading and false. There is also misleading advertising diet pills in the cosmetics and even toys that are advertised for young children.

I think that drinking red bull with alcohol increases the risk to suffer a myocardial infarction. I don’t know if this is true but if it is, for me is more important to claim for this reason than for the fact of not getting wings. But if you can get any money for claiming I will claim to get money to travel with my friend during de summer to have a good time after this hard year.

That happens every time you see an advertisement on tv or magazines .
I tried Redbull when i had exams and i could avoid being sleepy but i never hope to have wings.

  60. If I tell you the truth I have never drank an energetic drink, in this case we are talking about Redbull. Nowdays this type of drinks are becoming popular mainly in young people. Normally these drinks have catchy and attractive slogans whose aim is to attract people, but a slogan is a simply sentence so you don´t have to believe it literally. So in this case I wouldn´t claim for money as when I drink a redbull I know that it wont give me any wings because it is imposible. I think that you have to be so silly to believe that a drink will give you special powers. People often drink redbull when they have exams and need energy to study hard.

  63. I personally would not demand to Red Bull because it is a simple advert that I do not believe that we should extract of context, the whole world knows that it is not possible to fly is a simple shot of energy that us contributes major performance with minor weariness and even this way we buy it, buy it knowing what is and we accept it. In addition if it is bought once and we do not agree with the product it does not return to buy and does not need of giving the orders for a few simple dollars. Those that have the intention of demanding are in his right but he would say to all of them that it does not deserve punish and that with the simple fact of stopping consuming the product will be punished to the company.

  64. In my opinion I would not claim the money because it looks like to me a bilge. It is obvious that a drink is not going to give you wings. Though partly, the man who demanded to the company of Red Bull has reason. The campaign of advertising should not give this "so "powerful" and intense image of the product since later the clients feel unsatisfied for not feeling the effects waited after drinking a tin. It is true that this drink you accelerates a bit and you feel more assets, but you are not going to fly. As conclusion I think that to treat with this matter is worth it; there are things many more important that to attend nowadays.

  66. “Red Bull gives you wings”. This slogan has always represented the Austrian company Red Bull. Well due to a collective demand from many consumers have to pay 13 million dollars by not keeping his promise. This is the danger of defrauding consumers with false advertising for so long without thinking of the consequences. Now the company Red Bull provides the option of 10 dollars in cash, or $ 15 worth of free Red Bull. The only problem is that this option is only available in the US, when it should be in every country where you can buy this drink, However, the agreement still must be approved by a New York court on May 1, 2015, so that the applicants could not claim payments until 150 days after the final resolution

This slogan is just part of marketing and advertising company. These ads are funny and they are made with the purpose of attracting the public, especially teenagers. The largest consumers of energy drinks are young people. Obviously, the message provided in the ad is just to give you additional energy to be stronger in your studies, practising sports or having fun. With the final statement included in the Red Bull marketing campaign it is clear that nobody else will win a lawsuit against this company.

The effect that Red Bull causes in the people depend on the type of person, characteristics or weight of each one. But it´s true that these drinks cause a change in the body of the person because it has different ingredients like Taurine or Cafeine which causes a strange sensation of powerful, hyperactive and energize. it tasted good but had much gas. respect to its size, the largest is over and the small is ideal .with respect to the quantity / price is a scam because of its high price in these two unique numbers.
